The legal spat between Capcom and New Line Cinema over similarities between Dawn of the Dead and the game Dead Rising went full blown today, as Romero sued Capcom for copyright infringement.

As reported earlier this month, legal letters had passed between the two parties recently, with Capcom filing to have a court recognise that Dead Rising wasn’t unnecessarily similar to the zombie film.

“Both works are dark comedies,” the complaint filed in US District Court in New York on Monday reads. “In both, the recreational activities of the zombies and absurdly grotesque ‘kill scenes’ provide unexpected comedic relief.”

“Both works provided thoughtful social commentary on the ‘mall culture’ zeitgeist, in addition to serving up a sizable portion of sensationalistic violence,” it said.

  1. “Both works provided thoughtful social commentary”?

  2. Innit. They’re deep, man.

  3. I wouldn’t let Capcom get away with it if I were New Line. Straight up rip-off. And wasn’t Romero making a zombie game at some point?

  4. He was supposed to be, yeah. Maybe that’s why they’re getting so angsty about it. I tell you what: I would like to be sued by New Line Cinema. I suspect they can bring major courtroom pain.
