What’s to prevent Nintendo from just firmware-updating this into uselessness every couple of weeks?

Absolutely nothing, though only a few versions of Freeloader were needed during the life of the Gamecube. They may take a tougher stance on this with the extra online functionality of the Wii though.

Would Nintendo really bother if it doesn’t impact on piracy? (i.e. region unlock only no naughty backup play)

Nintendo do like to spoil the fun of potential importers, so yeah, they probably will bother. To what extent is the real question though.

This is a tough one to call. On one hand, NoE could do without more bad press after all the various delays, but on the other hand, they put region protection in the box for a reason.
